End User License Agreement

All Skeleton sponsorship, incentives, and incentive licensing are tended by Skeleton Labs LLC.

When sponsoring Skeleton on platforms such as GitHub Sponsors, Ko-Fi, or Patreon, you may gain access to unique incentives, such as Skeleton website templates (Items). By doing so, you agree to the following End User License Agreement (EULA). This serves as a legally binding and valid contract between you and Skeleton Labs LLC, and you are bound to it - including all intellectual property laws, as well as all terms and conditions presented within this agreement.

If you do not agree to be bound by this agreement, please remove any item from your personal devices and, if applicable, promptly return all related assets to Skeleton Labs LLC that may be within your possession.

Licensing Period

Each Item’s License is available for the lifetime of the product. Once obtained, the license exists forever following the restrictions provided within this document. Each item is provide as-is, with no contract or agreement for additional support. For more exact terms, please review the details for each specific license provided below.

The Source Code

Skeleton Labs LLC offers the source code for each item. However, obtained items include and utilize additional open source tools and services not owned or operated by Skeleton Labs LLC. This may include but is not limited to: Svelte, SvelteKit, Tailwind, Vite, Font Awesome, and Google Fonts. Skeleton Labs LLC claims no ownership over the intellectual property of these tools and services. Please review the terms of use of these services at your own discretion.

Use of Skeleton

The Skeleton UI toolkit library is provided as free and open source software by Skeleton Labs LLC under the MIT license.

Personal and Commercial License (Common Terms)

The following are terms are shared between both the Personal and Commercial licenses for each digital product (Item; End Product):

  1. Each end product must be a customized implementation of the item.
    1. For example, website templates must make use of your own content and images.
  2. You are free to modify the source code of each obtained item. You may also combine one or more obtained items, so long as you own a license per each item and fulfill the item's license agreement.
  3. You may not redistribute the item as stock, within a tool or template, or share the source files in their original unmodified state. This means you are not permitted to distribute the item as-is with only superficial modifications.
    1. You cannot create a web template or content management system template (e.g. Wordpress, Ghost, Shopify, etc.) for resale or for redistribution.
    2. You cannot license the item and make it available as-is on any other physical or digital store platform.
    3. You cannot provide a download to the source code as-is from a personal website or online host.
  4. The item may not be used within an application allowing the end user to provide personal and cosmetic customization, such as a "website builder", "Content Management System (CMS)", or any form of "on demand", "made to order", or "build it yourself" applications.
    1. Please contact Skeleton Labs LLC to establish an Enterprise License for this use case .
  5. You must not permit end users of the end product to extract the item and use it separately from the end product.
    1. For example, you cannot permit each website template's custom theme to be redistributed or resold.
  6. The item cannot be used in a logo, trademark, or service mark.
  7. Some items may contain source code provided from a third party service. The source code for those tools and services are subject to the license established by their original authors. Not all terms provided by these third party tools and services may be covered under this license.
    1. For example: a template might contain third party images licensed under the Creative Commons CCBY license. The CCBY license would then apply to those images, but not extend to the item obtained itself.
  8. Items may be used only for lawful purposes. Items should not be used in a manner that would be illegal under the jurisdiction of the obtainer's country.
  9. This license is applied in conjunction with this store's privacy policy. If there is an inconsistency between this license and the privacy policy, this license will only apply to the extent required to resolve the inconsistency.
  10. This license can and will be terminated if any or all terms are breached. When this occurs, you must stop making copies or redistributing the end product until you can remove the infringed item.
  11. Skeleton Labs LLC retains ownership of the item, but grants you a license under all terms stated within this license. The license is established between Skeleton Labs LLC and the obtainer.

Personal License

The Personal License grants the obtainer an ongoing, non-exclusive license to make use of the digital product (Item; End Product). In addition to the shared license terms, the Personal license is subject to the following additional terms:

  1. This license allows you to create a single end product for yourself or a single client (known as "single application").
  2. The end product can be distributed to a single online web host as a single website.
  3. You may create any number of local copies of a single item for personal use. However, you may not copy this to multiple hosts, provide copies under multiple domains, or share these copies with third party clients.

Commercial License

The Company License grants the obtainer an ongoing, non-exclusive license to make use of the digital product (Item; End Product) you have selected. In addition to the shared license terms, the Commercial license is subject to the following additional terms:

  1. This license is provided as a "multi-use" license and not a "single application" license. This means you can use the item to create more than one unique end product.
  2. This license grants you the ability to create multiple end products for yourself and/or third party clients.
  3. You are allowed to sell and make any number of copies of the end product, both for personal or commercial usage.
  4. This license allows you to create unlimited end products and deploy as multiple sites, such as: example1.com, example2.com, example3.com.
  5. You may customize and alter the end product for a third party client. The client's version of the item is then covered by a Personal License, unless a Commercial or Enterprise license is established between the third party client and Skeleton Labs LLC.
  6. You may modify or manipulate the item. You can combine the item with other works, as well as create derivative work. However the resulting works are subject to the terms of the commercial license.

Enterprise License

The terms an Enterprise License must be established in full on a case-by-case basis between the obtainer and Skeleton Labs LLC. Please contact admin@skeleton.dev if you wish to establish an Enterprise license for any of the Skeleton templates.

Use cases covered by this license may include, but are not limited to:

  • Establishing a license for wide scale resell or redistribution
  • Utilizing items, such as website templates, within tools like website builders
  • Creating derivative works for other platforms (to resell and distribute from custom storefronts)
  • Creating derivative works ported to other technologies (React, Vue, etc)
  • Any other use case not covered by the current Personal or Commercial licenses

Updates to Terms

Skeleton Labs LLC reserves the right to update and modify the terms of this End User License Agreement at will.
